ProfitBrainAI provides artificial intelligence automation, consulting, structural model development, and deployment services (collectively, the "Services"). These Terms of Service constitute a legally binding agreement between you and ProfitBrainAI regarding your use of our platform and custom enterprise deployments. By executing an Order Form or accessing our proprietary toolsets, you agree to be bound by these terms. We reserve the right to modify the scope of standard Services to accommodate technological advancements in AI frameworks.
We adhere to strict data protection and encryption standards. Any proprietary data, customer lists, or internal documentation provided by you for the purpose of fine-tuning models remains your exclusive intellectual property. ProfitBrainAI will never use your private data to train foundational models for other clients, nor will we disclose sensitive operational parameters to third parties without explicit authorization. Security audits are conducted quarterly to ensure compliance with global data handling regulations.
All specific generated outputs, code configurations, custom integrations, and structural workflow models produced by ProfitBrainAI during the engagement are transferred to the client upon full payment of the associated invoice. ProfitBrainAI retains ownership of our underlying, pre-existing proprietary frameworks, methodologies, and base AI wrappers used to facilitate the creation of your custom assets. We grant you a perpetual, non-exclusive, royalty-free license to use those underlying components as they exist within your finished deployment.
You own everything the AI builds for you once the invoice is paid. We never hold your intellectual property hostage or claim ownership over your custom data models.
To the maximum extent permitted by applicable law, ProfitBrainAI and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or operational continuity, resulting from the deployment of AI automation solutions. Because AI systems operate probabilistically, clients are responsible for implementing human-in-the-loop oversight on business-critical workflows unless otherwise specified in an explicit Service Level Agreement (SLA).
